Hi, I have just bought the business version of your cart software and almost have it completely set up (nice and easy apart from this)

I need to get rid of the requirement to register and have a validation email (its an un-necessary step and going to cost conversions with no upside)

How would I go about doing this ?

You can change the "registration" option of the Checkout tab of the configuration to "no registration".

I don't see any floating there.
Nevertheless, this often happens because of the CSS of the template which defines .modal instead of div.modal in its CSS and modalise the terms and conditions text as a result.
changing the CSS definition from .modal to div.modal in your template's CSS should fix that behavior.
