i would like to edit the "terms & conditions" - where can i find them or create them?

Hi

If you go to Hikashop, then choose Configuration, you will see a tab called Checkout.

In the first column right at the bottom is Terms and conditions, hit the Browse button and use a article for your terms and conditions, very nice :)
